Kenya: Family Plea Over Death of Tycoon

Nairobi — The family of slain tycoon Yogan Madan Mohan Sapra wants to be enjoined in a suit seeking to terminate a manslaughter case against his wife.

Lawyers Sharad Rao, Manjit Billings and Prof Githu Muigai told Lady Justice Jeanne Gacheche that the family of the deceased wished to participate in a constitutional application by Dr Nisha Sapra to quash the case against her.

Mr Rao said the application by the family of Mr Sapra, who owned the chain of Maya Duty Free shops at the Jomo Kenyatta International Airport, has been set for hearing on January 18, 2010.

The lawyer said: "It is now not possible to list the main motion of my client since there is pending application by the family."

Dr Sapra, a dentist, is asking the high court to terminate the case in which she has denied killing her husband on August 20/21, 2005 at their apartment in Spring Valley, Nairobi.

Justice Gacheche heard the AG has instructed a state counsel Mr Geoffrey Obiri to oppose the application by the accused.
