Lagos — Fromer President of the Nigeria Bar Association (NBA), Olisa Agbakoba, has described the resolution of the Senate mandating Vice-President Goodluck Jonathan to take over from President Umaru Yar'Adua in acting capacity as clumsy.
Speaking to the Daily Independent on Tuesday Agbakoba argued that "it (resolution) is a clumsy way of resolving the issue, it is the most untidy, and I hope it would not be challenged in a court of competent jurisdiction."
Also speaking, a Senior Advocate of Nigeria (SAN), Niyi Akintola, said the Senate resolution can only be legally valid if the Chief Justice of Nigeria, Alloysious Kastina-Alu, was directed to swear in Jonathan as acting President.
Akintola argued that the resolution was just a form of endorsement of doctrine of necessity to get out of political quagmire in which the country has found itself.
He noted that the Senate made a great blunder by not impeaching the President.
"Initially, and abinitio, the Senate know that they have abdicated their responsibility in the sense that Section 143 gave them the leeway of what to do and they have all the time of this world to commence impeachment proceedings against the President. But they did not do it.
"Today, they acted on the BBC interview as tantamount to transmitting a letter. The question is when does it occur to them that the BBC interview amounted to notice?"
