Liberia: "Judiciary Inquiry Commission is a Death Track for Judges"

The Stipendiary Magistrate of the Bensonville Magisterial Court Judge Peter T.K. Gonsahn, has described as complete 'death track' for Magisterial and Traffic Courts Judges the setting up of the Judiciary Inquiry Commission by Chief Justice Johnnie Lewis.

Responding to a complaint filed by David and Miata Padmore of alleged judiciary mal practices, Judge Gonsahn said the Judicial Inquiry Commission which is being headed by Justice Jamesatta Wolokollie is illegal and unlawful because according to him, said Commission was mainly set up to hunt Magisterial and Traffic Court judges.

In his 6 counts motion to dismiss said compliant, Judge Gonsahn contended that he has not violated any provision in the judicial canons for him to be investigated by Judicial Inquiry Commission.

He added that the Judicial Inquiry Commission has no jurisdiction over the subject matter because according to him, the cases in point were legally decided and no appeal were taken.

"Respondent further submits and says that only Judges of Circuit Court have the legal authority to review or investigate all compliants against Magistrates and justices of the Peace in keeping with Judicial laws and rules 33 and 34 governing the Circuit Courts of Liberia and not Judicial inquiry Commission". Judge Gonsahn noted.

Judge Gonshan has however called on the Judicial Inquiry Commission to dismiss the petitioners compliant for what he calls lack of jurisdiction.
