Kenya: House Team Consults on Fate of TJRC

Nairobi — A Parliamentary committee is seeking legal advice on the procedure it should follow to dissolve the Truth, Justice and Reconciliation Commission.

The legal counsel, expected to be delivered by National Assembly lawyers next week, was meant to ensure MPs do not face the same flak they received after they disbanded the Electoral Commission of Kenya, sources said.

The decision was reached at a meeting of the committee on Administration of Justice and Legal Affairs on Wednesday to discuss the fate of the crisis-hit TJRC.

Sources at the meeting, chaired by committee chairman Mohamed Abdikadir, said a majority of the members want the commission dissolved.

Last month, Justice and Constitutional Affairs minister Mutula Kilonzo requested them to start the process of disbanding the TJRC. On Tuesday, the minister confirmed that he asked the committee to initiate the process of dissolving the commission.

"I asked the committee verbally to initiate the process of disbanding this commission when they summoned me and my permanent secretary to appear before them last month. That was even before the current shenanigans started," he said.

The committee has the options of repealing the TJRC Act to dissolve the commission or review the appointment procedures to put in place a new team. It can also ask the Chief Justice to appoint a tribunal to investigate the conduct of the commission.
