The STX Korea Housing deal is still in place and not withdrawn as many are asserting but rather it was the motion and the committee's report that was withdrawn on the floor of parliament to help the Finance Committee of Parliament deliberate on certain aspects of the draft, the Minister for Water Resources, Works and Housing, Hon Alban Bagbin has announced.
In explaining why the motion and the committee's report was redrawn on the floor of Parliament to a section a journalists in Accra on Wednesday, the Minister said that "when the debate commenced on the adoption and subsequent approval of the terms of the loan, some members of parliament, notably Hon Anthony Akoto Osei and Hon Joe Ghartey reiterated some concerns that had been deliberated upon at the Committee meetings and agreed on by consensus."
Among these concerns raised by the minority members, The Minister mentioned were the reference to STX Engineering and construction as 'lender', the over securitization of the loan, the waiver of sovereign immunity and the waiver on taxes.
He explained that "by the laws and practice of democratic constitutional governance , when the terms and conditions of a loan facility are laid before Parliament they become the property of Parliament as the Housing deal was done on 4th May 2010", adding that all copies of document were given to all members.
In addition he said that "all members of Parliament are permitted by the rules and practices of Parliament to attend the Committee meetings and contribute to the discussions. "At the committee meeting, requests are made for additional documentation .These are usually given to the Committee members and any other member attending the meeting", stressing that it was also normal to request for these documents during debate on the floor.
According to him, the "Attorney-General had earlier given her written advice to the effect and that Parliament agreed to allow a Joint Committee on Finance and Works and Housing to re-look at the issues and report back to the House.
He emphasized that, "this was the same position of H.E the president, John Attah Mills who insisted that a nationalistic view be taken of the matter to achieve a broad base consensus and not a partisan decision" but it was never the case that the president redrew the STX deal as many are alleging.
On the issue of competence raised by the media and the minority soon after Parliament suspended the debate and withdraw of the report regarding to the deal, the Minister said that on the 15th March, 2010, the attorney General did review of the agreement and advised that the provisions of the Agreement be cleaned up to reflect the thinking of the current comments.
