Magistrate Hillary Abeke of Banjul Magistrate Court, last Friday, remanded Modou Sowe following his plea of guilt on the two charges of attempt to commit felonry, contrary to section 364 of the Gambia 1990, and corrupt practices, contrary to section 360 (b) of the criminal code cap 10. Volume III laws of the Gambia 1990.
Dwelling on the facts of the case, Cadet Inspector Ebrima Manneh, appearing for the Inspector General of Police (prosecution) explained to the court that on the 25th August 2010, the accused (Modou Sowe) went to the compound of Pa Naban in Bakoteh, Serrekunda, and that upon arrival the accused requested from Pa Naban to help him write a letter to the president for job assistance.
Cadet Inspector Manneh said the said letter was written and typed on behalf of the accused person and was later delivered at the state house by the accused person, himself. He said a few days following the delivery of the letter a directive was addressed to the I.G.P from the office of the president regarding the content of the previous letter sent by the accused person.
"The directive letter from the president's office addressed to the IGP argued that the accused wrote the letter to the president to bribe him with a piece of land situated at Kerr-Galo in Numi in the North Bank Region (NBR) and as a result of the above fact the accused was arrested, charged and put before the court" submitted the prosecutor.
The cautionary statement, voluntary statement, the letter of the accused and the written directive were tendered and marked as exhibits A, B, C and D respectively.
As for the particulars of offence on count one, it is stated that ' Modou Sowe on or about the 31st day of August 2010 in the city of Banjul you attempt to bribe the president through the Secretary General for a job assistance in exchange for land, thereby committed an offence."
The particulars of offence on count two indicated that "Modou Sowe on or about the 31st of August in the city of Banjul republic of the Gambia, you wrote a letter to the president through the secretary general office of the President for him to help you with a job in exchange of a land for bribe, thereby committed an offence."
The accused was remanded after his plea of guilt to both charges against him. The magistrate adjourned the case to Monday 6th of September for judgment.
