Asaba — A motor mechanic has been sentenced to death by hanging for armed robbery.
He was sentenced to death for robbing a University Lecturer of his car stereo at gun point in company of another accomplice, now deceased.
Prosecution led by the State Director of Public Prosecutions, Mr. Marcel Okoh called four witnesses to prove its case.
The mechanic along with another person were accused of robbing one Johnson Unuerho of his car stereo on the 29th of June, 2002 armed with a gun at Okpara Inland within Isiokolo judicial division.
However the 2nd accused persons one Gabriel Iyerowho, a driver was discharged and acquitted.
The victim of the robbery incident, who was PW2 (prosecution witness), a Principal Lecturer attached to the College of Education Warri, narrated how he tip-toed to the window, opened the blind gently and saw the 1st accused person, Patrick Ekeh and another member of the gang now deceased before shouting for help.
Justice Fred of Oleh High Court in Delta, in his judgment stated that "in the final analysis, I uphold defence of alibi of the 2nd accused persons. It ought to have been investigated by the police but was not. And besides, he was not one of those sighted by the PW2 when he took a peep through the window of his house and so no evidence fixing him at the scene and sufficient to dislodge the alibi raised by him.
While sentencing the accused, he said, "this is an offence of armed robbery for which I have no discretion. The penalty is death and I am not in a position not to impose it. To this end, the accused person is sentenced to death by handing in the neck until he is dead", the judge stated.

This is justice system, Nigerian style; same law It works one way for the northern offender but conversely for the Southern offender. In this case in hand, the plaintiff (victim of the armed robbery) had no physical contact with the accused. He tip-toed to and peeped through a window, then raised an alarm for help. only a few weeks ago, a Boko Haram terrorists, who named a sitting Senato, Alir Ndume, as a covert informant of the insurgent was convicted for belonging to a terror group that murdered and still murdering hundreds of innocent citizens in cold blood. He almost got a reprieve had the claim by his father for insanity been pressed harder. Besides, we all know he will be smuggled out of a prison back window and spirited away, to rejoin the ranks of Hausa/Fulani Butchers. Sen. Ndume, the perfidious informant and accomplice, is not even in police custody, or charged for involvement with a sect that vowed to annihilate "infidels" overthrow the Federal Government and impose sharia. The reason is simple. The mechanic who took a car radio -not even a rickety car- is a Southerner and must die for "armed robbery". Sen. Ali Ndume and his convicted accomplice in mass murder are northern Hausa/Fulani sacred cows, whose victims are invariably "worthless Southern Infidels". That is what it takes to have the "one-Nigeria" that serves the capricious interest of the Islamic North. This is the rubbish southerners are expected tot put up with.
Interesting development coming from Nigeria. So a car stereo thief gets the death penalty while someone who steals billions of state funds gets locked up for six months in a country club and then released to do it over again? A senator accused of sponsoring Boko Haram terrorist group is today a free man and these desparately unemployed kid gets to hang for what - yep, stealing a car stereo. This is justice at its best and only in Nigeria.
This case needs looking into again. How do you define "armed robbery"? There is no evidence that the accused in this case was armed, nor did he threaten the defendant any arm.
The world is nowadays a global village and Nigeria is, willy-nilly, a part of this global village. Those in authority should stop behaving as if the outside world has no interest in what goes on in that country.

WHEN A PERSON IS GUILTY, HE/SHE MOST BE DELT WITH ACCORDINGLY BY THAT COUNTRY'S LAW. NO ONE HAS THE RIGHT TO DICTATE TO OHTERS HOW THEIR JUDICIARY SYSTEM SHOULD OPERATE - NO ONE.
