Kenya: Sonko Accused of Framing CDF Chief in Corruption Trial

Former Makadara CDF chairman Vincent Shimoliis facing corruption related offences has accused MP Gideon Sonko Mbuvi of instigating charges against him.

In his affidavit filed at the Anti-corruption Court, Shimoli claimed that he knows that his prosecution was at Sonko's instigation to conceal or cause confusion as concerns the MP's involvement in the irregular and unlawful removal of Sh6 million from Makadara CDF account.

Shimoli, who is also former area parliamentary candidate in the 2007 general election, said in his affidavit that Sonko also involved in irregular removing of another Sh919,000 from CDF. He said the first money was removed on December 21, 2010 and the second on December 3, 2010. Shimoli, through his lawyer F. Amolo, made the accusation in an affidavit he has filed in court while opposing application by Director of Pubuilc Prosecution Keriako Tobiko to enter nolle prosequi in the case.

He said the DPP is seeking the proceedings be discontinued the case without giving any reason why the proceedings should be discontinued at the take when seven witnesses have already testified in the case. Shimoli is charged alongside CDF secretary Michael Geoffrey Maina. They are accused of corruptly giving Makadara MP, Sonko over Sh300,000 as inducement to enable them withdraw some money from CDF account.

In his affidavit, which was also served to prosecutor, chief inspector Robert Kyaa, Shimoli said that he is opposed at the discontinuance because the move violates his fundamental right under Article 50(2) (e) of the Constitution of Kenya 2010 for for trial to begin without unreasonable delay. The prosecutor however asked for two weeks to go through the affidavit and also to receive further instructions from DPP.

Shimoli said that Sonko appointed his new CDF committee immediately he was elected the area MP. He said sometimes after January 5, 2011 Sonko telephone him and informed him that the incoming committee has setled a budget amounting to Sh55,000 which was to be applied to meet the expense in connection of the handing over and taking over exercise. Shimoli says that he and his co-accused Maina were arrested by officers KCC while awiting in his car to meet Sonko who had informed them to wait for him at agreed place. He said they were taken to the Integrity Centre.
