Gambia: Pa Mbye, Foday Barry Discharged

The Banjul Magistrates' Court, presided over by Principal Magistrate Taiwo Ade Alagbe, Thursday, July 19th, 2012, discharged Pa Habibou Mbye and Foday Barry, the former Crime Management Coordinator and former director of Intelligence and Investigation at the NDEA, following a Nolle Prosequi (drop a lawsuit) that was filed by the state and moved by the DPP in the said court.

When the case came up yesterday, the director of Public Prosecution SH Barkun said he filed a Nolle Prosequi dated on the 18th July 2012, for the state's intention to discontinue with the trial of the accused persons. The DPP further applied to move the said document before the court.

The presiding magistrate, stated that he has gone through the document filed in by the state, further stating that going by the provision of Section 85 (1) (C) of the Constitution of the Republic of The Gambia, the state will discontinue with the case and the accused persons were discharged accordingly.
