Namibia: Christian Thinks to Sue Judge Smuts

Windhoek — In a legal first for Namibia, Hendrik Christian who lost his civil suit against the Namibia Financial Institutions Authority (Namfisa) wants to institute legal proceedings against the presiding judge in the matter, Dave Smuts.

Christian is applying to the High Court to grant him consent to sue Judge Smuts in terms of Section 21 of the High Court Act 16 of 1990. This particular Act states that a person involved in a legal dispute with a judge of the High Court needs to get permission from the High Court to institute legal proceedings against the judge with which that person has a dispute.
