Nigeria: Lawyers Slams N250 Million Suit Against Arik, NCAA

A Lagos-based lawyer, Mr. Chijioke Emeka, has dragged Arik Air before an Ikeja High Court, seeking N250 million as damages for negligence.

Also joined in the suit as a defendant is the Nigerian Civil Aviation Authority (NCAA).

In the suit, the lawyer complained that Arik made some misleading and reckless statements on its flight times on its website, which he acted upon and lost several amounts of money in cancelled briefs from his clients.

Emeka, who is a litigation partner with Olisa Agbakoba and Associates, a leading law firm in Lagos, claimed that on three occasions, he purchased tickets from Arik and on each occasion it turned out that the advertised time which he acted upon was different from the time eventually issued on the ticket after Arik received payment.

The aggrieved lawyer cited Lagos-Asaba and Lagos-Owerri on June 23 2012 and Owerri to Lagos on July 23, 2012 as instances. For Lagos-Asaba, Arik advertised 8.30am and issued him with 12 noon.

To meet up, he paid for 7.30am Owerri and got 11.00am.

For the Owerri-Lagos flight, while he paid for 11.55am, the flight left by 10.50 am, an hour before the advertised time, causing him to miss a lucrative brief.

He also demanded damages against NCAA for failing in its duty imposed by law to effectively regulate the aviation industry and protect him from the losses he suffered based on Arik's negligent misstatements.

The lawyer is listed as a witness while persons who have suffered similar experience are also proposed as additional witnesses.

No date has been fixed for the trial of the suit.
