Egypt: Prevention of Supreme Constitutional From Performing Its Job Complete Collapse of the State and Its Dignity

press release

In an unprecedented incident, President Mohammed Mursi"s pro-demonstrators have prevented a supreme judicial institution which is the Supreme Constitutional Court from performing its judicial job today. The demonstrators were in a sit since yesterday evening before the Court to prevent it from considering the claims of the constitutionality of the laws of the establishment of the Constituent Assembly and the Shura Council elections, in an anticipation of the verdicts of the dissolution of the Assembly that would have been issued and therefore the invalidity of what has been issued or will be issued, like the draft of the constitution and the invalidity and dissolution of Shura Council.

The Arab Program for Human Rights Activists regrets what is happening in Egypt of extreme tension, complexity and escalation of events ahead of the issuance of the Constitutional Declaration on 22 November, which enclosed severe and clear assault on the judiciary. Firstly, APHRA confirms that his defense is not for judges - although many of them are honest people who deserve the defense - but his defense is for the judiciary authority in the face of the predominance of the executive authority on its powers and mandates, which is contrary to the international principles on the independence of judiciary.

Secondly, APHRA asserts that the attack on the judiciary in this way is contrary to the rules and principles of the United Nations on the judiciary and also violates the provisions of the Egyptian Constitutional Declaration issued on March 30 and still governs the ruling in Egypt at the moment and upon which Dr. Mohamed Morsi, the President of the Republic has been elected.

The Arab Program shoulders President Mohamed Morsi and his Party "Freedom and Justice" the full responsibility for their supporters and followers who blockade the Supreme Constitutional Court and chant and intimidate judges forcing them to postpone the session of the lawsuits today. It"s worth mentioning that the ruling party is who invited to demonstrations yesterday, in coordination with Nour Party and the Islamic groups where their sheiks have given speeches condemning those in Tahrir Square of apostasy, inciting hatred and threatening the national unity.

The Arab Program emphasizes that what happens in front of the Supreme Constitutional Court is full and deliberate demolition of the State of law and institutions and a building of new state of jungle law, threats and intimidation.

The Program calls upon Dr. Mohamed Morsi to act quickly to rescue what is left of the State dignity which has been collapsed by the hands of his followers and pro in front of the Supreme Constitutional Court and to hold those responsible for this major crime into accountability.
