Gambia: Alleged Rapist Acquitted, Discharged

The Gambia Court of Appeal presided over by Justice M.M Agyemang, Justice Na Ceesay Salla-Wadda and Justice Mama Fatima Singhateh yesterday struck out the notice of criminal appeal filed by the State against one Alpha Jallow.

The said Alpha Jallow was acquitted and discharged by the Special Criminal Court in Banjul for the offence of rape, but the state raised an objection and made an oral submission of notice of appeal under Section 285(E) of the CPC, and the said Alpha Jallow was subsequently remanded in Mile II Prisons.

When the matter came up, the court observed that the respondent Alpha Jallow was not present in court and the copy of the notice of appeal filed by the State was also not before the court.

When Justice Agyemang indicated that the said notice of appeal was not before the court, DPP S.H Barkun then gave a copy of the appellant notice of appeal to the court. The court was however informed that the said Alpha Jallow had been discharged and the appeal was subsequently struck out.
