Gambia: Prison Break Case Adjourned

The alleged prison break at Mile II central Prisons involving Sulayman Jammeh alias 'Dad' yesterday failed to proceed before acting Principal Magistrate Babucarr Secka of the Banjul Magistrates' court on grounds that defence counsel Ebrima Jah informed the court that he was applying for an adjournment because some issues came to his attention;

adding that in the interest of justice and in public interest, he would like to address this issue by writing to the appropriate authorities. He therefore prayed to the court to grant him a week adjournment to enable him do so.

The application was granted by the trial magistrate when no objection was raised by prosecuting officer, Saja Sanyang.

The Particulars of offence stated that Sulayman Jammeh and 18 others on or about the 27th day of October, 2012 at the Remand Wing of the Mile II State Central Prisons, in the City of Banjul, Republic of The Gambia, with intent to commit a misdemeanor jointly conspired amongst themselves to damage the padlocks and break the remand wall respectively thereby committed an offence.

Count two, statements of offence: 'Willful damage to property contrary to laws of The Gambia.

According to the particulars of offence on count two, the aforesaid persons on or about the 27th day of October, 2012 with intent to commit a misdemeanor willfully and unlawfully broke the padlocks to the eleven Cells in the Remand Wing of the Mile II State Central Prisons, property of The Gambia Government thereby committed an offence.

Count three, particulars of offence stated that: Sulayman Jammeh and his co accused persons on the same day and month with intent to commit a misdemeanor attempted to escape from lawful custody by breaking the padlocks to the eleven Cells and destroying both room walls in the Remand Wing of the Mile II State Central Prisons thereby committed an offence.

The Particulars of offence on count four alleged that Gibbi Sey, Echen Mendy, Moses Mbajo, Abdou Sanno and Ousman Sonko on or about the 27th day of October 2012, at the remand wing of the Mile II Central Prisons, unlawfully assaulted one Corporal Amadou Tamba, a Prison officer by beating him thereby committed an offence.

The accused persons are: Sulayman Jammeh, Lamin Saidykhan, Gibbi Sey, Mustapha Camara, Echen Mendy, Lamin Danso, Muhammed Sighateh, Lamin Njie, Ousman Sonko, Ousman B Njie, Abou Saidy, Muhammed Dicko Abdou Sanno, Moses Mbajo, Musa Jallow, Fafa Fatty, Modou Mbenga, Basiru Bah, and Modou Musa Jallow.

The case is adjourned to 24th of December, 2012 for continuation of hearing.
