Kenya: Family Assault Case Adjourned

GATUNDU A case in which a woman and five of her children are facing assault charges against their father was yesterday adjourned. The case as put off after the defence lawyer told the court that she had not received witness statements.

Lawyer Catherine Kinyanjui told Gatundu Resident magistrate DM Ndingi said that the investigating officer in the case had insisted on a court order to before releasing the statements where Wambui Muchiri and her five children are accused of assaulting Joseph Muchiri at Kimunyu village in Gatundu in August.

The magistrate said the new constitutions allows accused persons to access witness statement without having a court order. She blamed the police for causing unnecessary delays and asked the prosecutor to follow up the matter and ensure that the statements are given to the advocate without any undue delay. The case will be heard on Thursday.
