North Africa: ANHRI Issues Manual for Lawyers in the Publishing Cases

The Arabic Network for Human Rights Information (ANHRI), issued a new manual entitled "Lawyer's Manual in the Publishing Cases and the Fair Trial", which falls in the frame of ANHRI's efforts to support the legal capacities of the human rights lawyers. It also represents an attempt to guarantee the best methods to defend whoever harassed; journalists, writers, creators or others, by the virtue of the publishing laws.

"Words mustn't go to court, we believe in that ... but governments and a lot of citizens - whether with knowledge or not- don't believe in that. The publishing and opinion's cases increase due to the unlimited justifications and allegations.

Therefore and as a result of the increase of the publishing and freedom of expression cases, we have made this manual in order to assist the lawyers, in particularly the young lawyers, who play a role in protecting the freedom of expression and who defend the rights of the others to express their opinions even if such opinions contradicts with them. To who prefer to answer the word by word and the idea by idea".

In the first chapter, the manual, presents the articles of the Egyptian laws that related to the publishing cases, then in the second chapter presents the articles that establish the right to freedom of expression and publishing in the international charters. After that in the third and fourth chapter the manual presents the practical aspects of the legal defense related to the publishing cases.

It presents the legal defenses in the form and in the subject before the public prosecution and courts in addition to models of such cases. The manual supports such defenses by presenting the legal principles and previous judgments to the Egyptian courts that established the right to freedom of expression and publishing in the fifth chapter. In the sixth, last, chapter presents the fundamental rules of the fair trial.

The manual was prepared by the Legal Aid Unit in ANHRI in the frame of the research efforts that complete its practical role in providing the legal support which represented in the direct legal consultations or through the hot line in addition to providing the legal defense before the public prosecution or courts. ANHRI hopes that this manual could help who works in the field of defending the rights and freedoms. ANHRI also hopes that it could represent an effective addition to the efforts of supporting these rights and freedoms in this critical stage, which witnesses semi-organized campaigns, by the authority and who are affiliated to it and to who belongs to the trend of political Islam, that aim to restrict these freedoms which no nation can achieve its renaissance without such freedoms are provided to the citizens.
