Nigeria: Akwa Court Dismisses Ukachukwu's Petition Against Uba

Owerri — The Court of Appeal sitting in Owerri, Imo State,yesterday, dismissed Prince Nicholas Ukachukwu's application, seeking to be declared the duly nominated candidate of People's Democratic Party, PDP, for Anambra South senatorial zone election, which was won by Senator Andy Uba.

Ukachukwu, who is plaintiff in the suit, has as respondents, Independent National Electoral Commission, INEC and Uba.

The Appeal Court held that Justice J. Umar, then judge of the Federal High Court sitting in Umuahia, Abia State, was wrong to have transmitted the application to the Court of Appeal.

The appellate court further held that Ukachukwu had no grounds of appeal on the real issue in question and subsequently refused to exercise its power under section 15 of the Court of Appeal Act to decide on who was the duly nominated candidate of PDP.
