Ghana: 18 Years Jailed 10 Years for Defilement

An Accra Circuit Court has sentenced an-eighteen-year-old unemployed to ten years imprisonment for having sexual intercourse with a-five-year-old girl in Kasoa in the Central Region.

The convict, Adjei Laryea, lured the class one pupil into a nearby bush, while her mother was fixing her hair and had sex with her.

The convict was, however, arrested by a witness close-by, after the victim had shouted for help.

He pleaded guilty to the charge of defilement of a child below 16 years, contrary to section 101 0f Act 29/60 as amended by Act 554 (1) 1998, when he was arraigned before the court, presided over by Ms Sedina Agbemeva. The court, therefore, convicted Adjei Laryea on his own plea.

The facts of the case are that on December 26, 2012, at about 10:00 am, the victim accompanied her mother, who happens to be the complainant, to a hair dressing saloon in the same vicinity.

The Prosecutor, ASP Sarah Acquah, told the court that while the mother was inside the saloon, the victim went out to play. While she was playing, the convict, who was passing by, spotted her and called her.

She told the court that the victim naively followed the convict to a nearby bush, close to an uncompleted house, and upon reaching there, he positioned the victim under a Nim tree, removed her pants and had sex with her.

According to the prosecutor, the victim, who could not endure the pain shouted for help and the witness upon hearing her scream, rushed to the location of the victim.

ASP Acquah mentioned that the convict immediately emerged from the bush and began running away, while the victim was crying and running toward the witness.

The witness sensed danger and raised an alarm, which resulted in the arrest of the convict, who was then handed over to the police, the prosecutor noted. The victim was issued with a medical form to attend to the hospital for examination and treatment.

She further stated that upon interrogation, Adjei Laryea denied committing the offence and stated that he rather attempted having sex with the victim when the witness appeared and he bolted.
