Nigeria: N6 Million Land Suit - Ex-Soldier Urges Court to Decline Jurisdiction

A retired Navy captain has asked a Nasarawa High Court to strike out a motion by retired group captain over N6 million land he purchased from him in 2011.

Captain Benson Idu Ogih (rtd) in a motion filed by his counsel Kenny Clet Esq. urged the court to strike out a motion by Group Captain Z.R. Zakka because the contentious issues of ownership of the plot located opposite Living Faith Church (Goshen) along Abuja-Keffi express Road in Nasarawa State.

In the motion Ogih contends that though he purchased the land from Zakka in good faith without knowing it was also sold to a third party, he had decided to await the outcome of the litigation by one Total Imani Nigeria Ltd claiming ownership of same plo even with his money has not been refunded.

Ogih is therefore contending that the suit is an abuse of court process adding that the court lacks the jurisdiction to entertain same.

The suit has been adjourned to February 8 for hearing.
