Former Gov. Gbenga Daniel of Ogun has appealed against the ruling of an Abeokuta High Court over the dismissal of his plea to quash some charges levelled against him by the EFCC.

In the appeal filed by his counsel, Prof. Taiwo Osipitan, the former governor sought the leave of the court to quash counts one to 13 of the charges relating to fraudulent conversion of land.

He argued that a Commission of Inquiry on lands had earlier indicted him on the same issues.

The trial Judge, Justice Olanrewaju Mabekoje, at the last sitting on Jan. 8, ruled against Daniel's application, insisting that an indictment by a Commission of Inquiry was a mere accusation which had still to be proven in a court of law.

At the resumed sitting on Friday, Osipitan told the court that he had filed an application at the Court of Appeal against the ruling.

He, therefore, sought for a stay of proceedings pending the hearing of his application at the Court of Appeal.

EFCC counsel Rotimi Jacobs denied knowledge of the application, saying he had not been served with copies.

Mabekoje, however, insisted that a copy of the application must be served on the court to enable it know the actual relief being sought.

He, therefore, adjourned the case till March 1, to enable the defence file the necessary papers.
