The university is contending in the suit, that since its inception in 1970 as Mid-West Institute of Technology, the institution started as the property of the defunct Mid-West State Government, which had metamorphosed from Bendel to Edo and Delta states.

It argued that like every new project, the defunct Mid-Weststate government committed it resources to ensuring the successful take -off of the institution.
