Mutula Kilonzo Junior's name will remain on the ballot for the Makueni Senate race after the Independent Electoral and Commission rejected a petition challenging his nomination by the Wiper Democratic Movement.

Kilonzo will remain in the race pending a hearing and determination of a similar petition filed yesterday by a voter, Agnes Ndetei at the Court of Appeal.

IEBC chief executive officer James Oswago said the commission's Dispute Resolution Committee cannot hear any more petitions regarding the Makueni by-election as it is time bad.

Oswago said the preparations for the election that is scheduled to take place this Friday have already began.

He said only the Court of Appeal can hear the case challenging Kilonzo's candidature as it was the High Court that made the decision to allow the Wiper party to nominate another candidate.

Mutula Junior's nomination followed a ruling by the High Court which determined that Wiper's initial candidate for the ticket, Kethi Kilonzo was not a duly registered voter and could therefore not vie.
