Though Presiding Judge Yussif D. Kaba few days ago granted the Government of Liberia's request to produce video and audio clips in open as demonstrated evidence in the ongoing mecernarism trial involving 19 Grand Gedeans, he overturned the decision yesterday by denying the Government of Liberia's request to produce or play said evidence video and audio clips in court.
The video and audio clips were testified to by the Government's fifth witness, Thomas Gluadio, who also claimed that the evidence linked the 19 defendants charged with Mercenarism. Judge Kaba decision to deny the playing of the video and audio clips in court was based a motion to suppress evidence filed by lawyers representing the interest of the 19 Grand Gedeans.
Judge Kaba who is said to be one of the long-serving Judges at the Temple of Justice said in his ruling that the video and audio clips were illegally obtained in that said evidence were gathered secretly as testified to by prosecution's fith witness Thomas Gluadio.
"Wherefore and in view of the foregoing, counsels for the defendants' motion to suppress evidence is hereby granted and denied prosecution's resistance," Judge Kaba said.
In their five counts motion to suppress evidence filed on July 25, 2013, defense lawyers led by Cllr. Tiawan S. Gongloe said during the testimony of prosecution's last witness told the court that he secretly recorded and photographed some of the defendants secretly and that he had said information on his person and was prepared to display same in support of his testimony.
Defense lawyers also argued in their motion that the video and audio clips that were obtained secretly by witness Thomas Gluadio were illegally obtained and not obtained through a search warrant or voluntary admission in accordance with law and such cannot be used in a court of law.
Meanwhile, prosecution fifth witness Gluadio who was present in court and expected to take the witness stand on the cross left the court unknowing to his lawyers and as a result of the disappearing of witness Gluadio from the court room, Judge Kaba scheduled the hearing for today at 10: am.
