Liberia: Government Intelligence Source Debated

Prosecution's "Special witness" Police Chief Inspector Savior Howard of the Emergency Response Unit (ERU) has told the court and jury during cross examinations that the Liberia National Police (LNP) "got intelligence from somebody who may have been part" of the accused Grand Gedeans in the commission of mercenarism.

Officer Howard said he did not arrest any of the three defendants, including Isaac Tanyon, Edward Cole and Neeze Barway with arms around the PTP Community and the Zianbo Quarter, but that he made the arrest based on instruction from authorities of the LNP.

18 Grand Gedeans are facing mercenarism charge, out of 19 Grand Gedeans that were on trial, but government has nolle prosequa one of them to testify against the remaining 18.

In response to defense inquiry as to whether the intelligence received by police that prompted government to list defendants Isaac Tanyon, Edward Cole and Neeze Barway came from community dwellers in Grand Gedeh, other security apparatus or the Liberia National Police (LNP), the witness said the source was Thomas Gladier.

Gladier had earlier testified in the case as ex-correction officer, having submitted videos and photos to prosecution. But the court has since denied the evidence on grounds of illegally videotaping and recording the defendants.

The defense had further sought to obtain from Witness Howard at what point the defendants were declared wanted for mercenarism, when prosecution objected to the question on grounds that it was intended to entrap the witness who was not part of the compilation process of listing wanted people.

Subsequently, Judge Yussif D. Kabba granted the prosecution's objection, and informed defense that inquiring from the witness reasons for the inclusion of the defendant's names on wanted list would entrap him.

The judge said the witness did not make mention of his involvement in the compilation of wanted list, except that he was instructed by authorities of the police to arrest the wanted individuals.

Based on Thomas Gladier's intelligence to the police and the subsequent listing of the three defendants as wanted by the Liberian Government, witness Howard said the three accused were arrested here in Liberia on Saturday, 14 July 2012.

"But more besides, the men arrested were involved in mercenary acts. I just told you these men's names were listed as wanted. Somebody who may have been part of them gave us the intelligence," he said.

On July 14, 2012 when he received the tipoff and made the arrest, Officer Howard said defendant Cole told the security that he did not want to suffer alone, asking the police to go alone with him at his (Cole's) house because he left his wife and children there.

Officer Howard said when he walked with defendant Cole at the window of his house, he (Howard) heard man responding to defendant Cole when he (Cole) knocked the window instead of woman answering.

"They spoke their vernacular; I turned him over to the police people and I walked to the main door of his house; when I saw the fellow inside, I announced myself as ERU and had him arrested," Howard testified.

He said the newly arrested man cried that he was not the mean man. However, Officer Howard said the females that were in Cole's house could not identify the man just arrested, thus, he was also taken along.

He said the defendants were turned over to ERU officers from Monrovia, and that they were brought to Monrovia where their particulars were taken at the National Police Headquarters.
