Kenya: Kethi Asks IEBC for Evidence Used in Her Case

Kethi Kilonzo has demanded all documentary evidence used during the hearing of a case to determine her nomination to contest the Makueni by-election.

In a letter to the IEBC, Kethi, through her lawyer Julie Soweto, has given the commission 24 hours to furnish her with the documents failure to which she will ask the High Court to compel the electoral body to give the documents.

She wants all reports of the IEBC referred to and produced by witnesses who gave their evidence before the Dispute Resolution Committee.

Kethi has asked for all reports mentioning her, a certified copy of the booklet of acknowledgement slips produced by the IEBC and a statement on oath detailing the chain of custody of the booklet, the date and the report of its theft.

She wants a certified copy of the acknowledgement slip of the retired President Kibaki and a certified copy of the distribution list of all the acknowledgement slip booklets.

Kethi has said she wants a certified copy of the register of voters with biometrics used at NCC Social Hall. In the petition in the High Court against the IEBC tribunal, a three-judge bench last month ruled that Kethi cannot vie for the seat prompting Wiper party to nominate her brother Mutula Kilonzo Jr who won the seat in the July 26 by-election.

Kethi wanted the court to reverse the decision by the resolution committee but the judges upheld the ruling. She had complained that the committee violated her rights but Justices Richard Mwongo, Mumbi Ngugi and Weldon Korir said the committee gave Kethi a fair hearing.

Her lawyers argued that Kethi is duly registered and presented three other IEBC acknowledgement slips to the committee which contained anomalies. Kethi said IEBC had failed in many aspects including the registration exercise. She has already filed a notice of appeal.
