Peter Weissferdt and Milko Berben were on Wednesday, 4 September, 2013 arraigned before Magistrate Lamin Mbaye of the Banjul Magistrates' court, charged with one count of alleged "Tax Evasion", contrary to Section 103 of the Income and Sales Tax Act, Laws of the Gambia. According to the particulars of offence, the aforesaid persons on or about the year 2013, in the City of Banjul and diverse places in the Republic of the Gambia, failed to pay tax amounting to Eighty Three Thousand, Eight Hundred and Ninety Two Dalasi (D83, 892. 00) to the Gambia Revenue Authority (GRA), being the income and value added tax (VAT) for the GAMWIND COMPANY LIMITED as at 20th of August, 2013 and thereby committed an offence.
Counsel for the accused persons objected to the charge sheet on the grounds that the Income and Sales Tax Act was repealed. She therefore urged the court to reject the charge sheet. Replying on the objection of the defence, Corporal 4224 Saja Sanyang argued that counsel cannot prove that the said Act was already repealed. He urged the court to allow the charge sheet and for the accused persons to take their plea.
The case is adjourned to 18th September 2013 for ruling.
