Sam Mugumya, Robert Kisekwa and Francis Mwijukye are charged with stealing a mobile phone and Shs 11,000 from a hawker, Ismail Muyingo, at Maliba trading centre on August 4, 2012.
The theft allegedly happened as the three participated in the re-election campaign for Kasese Woman MP Winnie Kiiza. Ironically, the hawker, claims to be hailing from Makerere-Kikoni in Kampala.
When the case came up before Grade One Magistrate George Mfitundinda last week, the police failed to produce two witnesses, an investigating officer who handled the file and a doctor who examined the victim.
Mfitundinda adjourned the case to November 5, but also dismissed an application for a judicial review on a matter rejected by the same court last year.
Mugumya, Kisekwa and Mwijukye had asked the court to present the hawker for cross-examination, a request dismissed by the court.
"I know this court can hear your application and consider it but I want the defence lawyer to be more composed and apply using the relevant laws on November 5, when this case comes for further hearing," Mfitundinda ruled.
