Kasungu — The Kasungu First Grade Magistrate on Thursday sentenced George Banda, 48 years old, to 13 years imprisonment with hard labour (IHL) for defiling his 16 year old step daughter.
The incident took place at Chimtengo Village, Traditional Authority (TA) Kawamba in Kasungu district.
Kasungu Police Spokesperson, Edwin Kaunda, told Malawi News Agency (Mana) that Banda started coaxing the young girl in 2010 but she never allowed him to have sex with her.
According to Kaunda, it was until 26th October, 2013 during the night when Banda went to the girl's bedroom and pleaded for sex again.
"Since her mother was at the hospital, the girl bowed down to his father's demands. She was unhappy with what had happened and later informed her uncle of the incidence," said Kaunda.
The uncle took the girl to Kasungu Police where they referred the matter to Kasungu District Hospital for medical examination which revealed that the girl was indeed defiled.
Banda was arrested the same day and appeared before the Kasungu First Grade Magistrate Court where he pleaded guilty to the charge of defilement.
In mitigation, Banda asked for leniency saying he cares for his old parents and that he also looks after orphans.
Passing sentence, His worship Hens Kamtchere, said that Banda did not deserve any leniency because what he did is equivalent to murder considering the fact he knew that he is HIV positive and deliberately defiled the girl.
Kamtchere, then, slapped him with a 13 year jail term.
Banda hails from Chimtengo Village TA Kawamba in Kasungu.
