The Industrial Court has issued an order outlawing the ongoing health workers strike until the case comes up for mention on December 24. Justice James Rika who issued the order directed all the parties involved in the case to prepare all the necessary documentation for the case.
The Cabinet Secretary for Health James Macharia last week obtained a court order from High Court Judge Justice David Majanja that outlawed the strike.
Majanja granted the order on the grounds that the strike by the health workers is unconstitutional and in contravention of the Labour Relations Act which bars workers in essential services sectors from taking part in industrial action.
Kenya Medical Practitioners and Dentists Association Secretary General Sultan Matendechere however dismissed the court order saying that no representative of the doctors or nurses had been served with the court order. The strike has now entered its second week.
