Kenya: Implementation of New Parking Few Halted Pending Matatu Saccos' Appeal

The High Court has stopped the implementation of a new packing fee proposed by the Nairobi County Finance Committee. The proposal seeks to increase the parking levy within the CBD from the current Sh140 to Sh300.

Justice Isaac Lenaola said the new fee will not implemented pending a hearing of an appeal by 26 Matatu Saccos on January 15 next year.

While dismissing the case Judge Lenaola said that the court cannot determine a reasonable parking fee because the charges to be levied are the exclusive jurisdiction of the County Government.

Lenaola further added that the only instance where the court can intervene in such an application, is in the case of an existing law being violated by the proposal of the County Finance Committee which the matatu saccos failed to prove.
