Kenya: Understanding the New Marriage Bill

Matrimonial rights and equality have been the greatest gains under the Constitution of Kenya 2010. Article 27 guarantees all the right to equal protection before the law. Article 45 focuses on the marriage institution. It provides that the family is the fundamental unit of social order. It stipulates that parties to a marriage are equal.

Indeed this must have been the fountain that informed the Marriage Bill which is expected to become a one-stop shop for all matrimonial issues. This is one of the legislative steps that Parliament has taken towards the progressive realisation of the Convention on the Elimination of All Forms of Discrimination against Women, to which Kenya is a signatory.
