Zambia: You Can't Prosecute Rupiah, Court Tells Mutembo Nchito

The Lusaka Magistrate Court has gone some way in checking Director of Public Prosecution Mutembo Nchito's obsession to persecute former President Rupiah Banda by ruling that he cannot prosecute Banda as he is motivated by hatred.

Magistrate Obbister Musukwa said Nchito was wrong to insist on prosecuting Banda because he had a well known grudge against the former Head of State whom he blamed for the closure of Zambian Airways after running it down due to heavy indebtedness.

Musukwa has ruled that the DPP cannot continue to prosecute Banda because Nchito has a vested interest in the matter.

He has adjourned the matter indefinitely until it is determined by High Court.
