Gambia: Court Frees Man Suspected of Defilement

Justice Simeon Ateh Abi of the High Court in Banjul, Wednesday, 28th January, 2015 acquitted and discharged one Nelson Mendy of dilement, declaring that the prosecution failed to prove the charge against the accused. Mendy is now a freeman.

Delivering judgment, the presiding judge recalled that the accused person is charged with one-count of defilement, contrary to Section 127 (1) of the Criminal Code Cap 10, Volume 111, laws of The Gambia 2009. The particulars of offence alleged that the accused person sometime in July 2013 at Lamin Village within the jurisdiction of the court had unlawful carnal knowledge of a 15-year-old girl (name withheld).
