You might want to get some popcorn for this one. It's Kenya versus the International Criminal Court (ICC), the sequel. Like any movie follow-up, the actors are the same, the script has been tweaked and, so far at least, the battle between the main protagonists is promising plenty of fireworks and plot twists. Kenya and the ICC have been dueling for a while, and many pundits had all but declared the East African nation the victor.
Kenya's eventual victory seemed so certain amid the tide of bad news for the ICC that it prompted Foreign Policy magazine to wonder aloud "Has Kenya destroyed the ICC?" Then last week happened. The ICC's appeals court ordered the trial chamber to review its decision on Kenya's cooperation in the Uhuru Kenyatta case, and judges admitted prior recorded witness statements in the Ruto case. Even Walter Barasa seems scared. The Standard reported this week that he is ready to take himself to The Hague if the ICC changes his arrest warrant into a summons. Now the question on everyone's mind is: "Is Kenya back on the ICC's radar?" What a difference one week makes.
