Sudan: A Kenyan Court of Appeal Lifted a Warrant Arrest Against the President

Khartoum — The Kenyan court of appeal in Nairobi issued a ruling on Feb 16, 2018, canceling a warrant of arrest issued against the President of the Republic Field Marshal Omar Hassan Ahmed Al Bashir.

A Circular by the Ministry of Foreign Affairs, on Wednesday pointed out that the verdict of the court of appeal argued that accepting the injection by the government of Kenya was based on the fact that the Kenyan initial court was not mandated to issue such a ruling and that dealing and cooperating with the International Criminal Court ICC was a matter concerning the Kenny government alone.

The ruling of the appellate court also dwelt on the contradictions and crossing between the international law on the immunity of the seated heads of state and government in addition to the position taken by the African Union which calls on member states not to cooperate with the ICC. The ruling also pointed out that at the bilateral level Kenya has good relationship with the Sudan.
