Tanzania: Court Throws Out Dismissed TRC Employee's Appeal

THE Court of Appeal has rejected the appeal lodged by former employee with Tanzania Railways Corporation (TRC) PatsonMatonya, who was dismissed from his employment for allowing some passengersto board a train from Tabora to Kigoma stations without tickets.

Justices Kipenka Mussa, Augustine Mwarija and Richard Mziray ruled against Matonya, the appellant, after holding that the appeal was incomplete, hence incompetent for containing a copy of the ruling, which was sought to be challenged, with missing one page.

"We agree with the view of (principal state attorney) and state without hesitation that the missing page vitiated the substance of the contested ruling and rendered the record of appeal incomplete. (Penalty) of filling incomplete records has the adverse effect of rendering the appeal incompetent," they ruled.
