The High Court in Nakuru has summoned Siaya Governor Cornel Rasanga to explain why he has not paid Sh6 million to two accident victims who were hit by a vehicle belonging to his government.
Justice Janet Mulwa ordered Mr Rasanga, his finance chief officer and the county secretary to appear before court to explain why they should not be punished for disobeying court orders issued on June 3.
The orders required the Siaya county government to pay Willy Kiptoo and the family of Erick Kirui Sh6 million compensation for the loss they suffered after they were knocked by a motor vehicle belonging to the county government.
The family of Kirui, who died on the spot during the accident,t was awarded Sh1.8 million and that of Kiptoo, who was admitted to hospital for one month after suffering serious injuries, was awarded Sh4.8 million plus the medical cost.
The accident occurred at Salgaa area on the Nakuru-Eldoret highway.
"The respondents should attend court individually or by their advocates to show cause why they should not be committed to civil jail for disobeying court orders," ruled justice Mulwa.
The judge issued the ruling following an application filed by the victims' lawyer Renny Lagat who sought to have the governor and his officers punished for contempt of court.
Mr Lagat in the application noted that the respondents have refused to honour the orders despite being served with the demand notice on June 17.
The court heard that the 30 days which had been indicated in the demand notice had lapsed yet the respondents have not complied with the orders.
"The suspected contemnors were and are aware of the decree of this court compelling them to pay the applicants the decretal sum but they have chosen to ignore the same. They have no regard to the authority of this court," said Mr Lagat.
The families filed for compensation and damages before the court in Molo in 2017 where they sued the county governor, county secretary and the chief officer finance after the accident.
The county government had appealed the judgement but decided to withdraw later promising to pay money.
The three are expected to appear on September 22.
