Kenya: Janet Waiyaki Murder - 2 Policemen Convicted of Manslaughter

The High Court on Tuesday convicted two police officers of manslaughter in the murder of a woman at City Park, Nairobi, three years ago.

Justice Stella Mutuku found Godfrey Kipng'etich Kirui and William Kipkorir Chirchir guilty of manslaughter in the killing of Ms Janet Waiyaki, on May 20, 2018.

Waiyaki, then aged 41, was shot dead while a relative, Bernard Chege, who was with her at the time of the shooting was left fighting for his life.

Mr Chirchir was an Administration Police officer from Makadara Police Station while Constable Kirui was attached to Industrial Area Police Station.

It is alleged the two fired 15 bullets into the vehicle that Waiyaki and Mr Chege were in that Sunday morning before Chege was rushed to hospital.

"I find that the offence of manslaughter has been proven against the first and second accused persons beyond reasonable doubt," Justice Mutuku said.

The judge added that the police officers used excessive force yet they were not in any danger at the time of the incident, and that they were reckless.
