Kenya: Laban Cliff Onserio in Anti-Terrorism Court Over Basilica Grenade Saga

19 December 2022

Nairobi — Detectives from DCI's Anti-Terror Police Unit are holding journalist Laban Cliff Onserio for possession of a stun grenade recovered from his car.

An affidavit filed Monday at the Kahawa Law Courts where Onserio was presented indicated he was arrested on Sunday at the Holy Family Basilica in Nairobi.

The prohibited device was flagged as the journalist accessed the parking lot within the precincts of the church.

Prosecution argued that the suspect threatened members of the public with imminent attack against them while holding the said grenade.

The suspect was apprehended by a multi-agency team who responded at the scene after receiving information on an imminent terror threat at Holy Family Basilica.

"THAT the Respondent could not give satisfactory reasons why he was in possession of the flash bang grenade neither produce a certificate allowing him to be in possession of the said explosive device," the Affidavit reads in part.

At the time of his arrest, the prosecution told the court the suspect was also found with three phones.

The ATPU wants to be allowed to hold the suspect for five days to allow them time for investigations.

They argued that respondent is suspected to be in possession of more flash bang training Model 7290T grenades which the investigating team requires more time to obtain search warrant for in a bid to recover.

"THAT this Honorable Court be pleased to issue a Custodial Order that Respondent herein be detained for five (5) days from today at Anti- Terrorism Police Unit Headquarters in Nairobi to allow the applicant conclude investigations," the police told Nairobi's Anti-Terrorism Court.

The prosecution also sought a court order authorizing the ATPU forensically examine electronic gadgets recovered from Onserio.

Prosecution argued that preliminary investigation revealed Onserio illegally acquired the flash bang grenade from a British national working with regional airline -- Fly 540 Airline -- whom detectives identified as Don Smith in 2021.
