Kenya: Procurement Body Urges Fair Procurement Processes

Nairobi — The Public Procurement Regulatory Authority (PPRA) has asked procuring agencies to follow rules and regulations that guide the process of procurement.

The regulator said that procuring entities should provide detailed procurement requirements to prospective bidders such as eligibility.

It revealed that it has received numerous complaints from the insurance industry players as well as prospective bidders on procuring entities who are out to set prohibitive requirements as part of their tender evaluation criteria in the bidding documents.

PPRA observed that the tendering process should not extinguish competition and fairness amongst bidders as it is contrary to the objectives of article 227 of the constitution.

"We have noted that some procuring entities are requiring bidders to provide requirements that are prohibitive and not proportionate to the estimated cost of services being procured, " read a statement by the regulatory body.

The body further revealed that it has sought the intervention of the Insurance regulatory authority which has since allowed for any insure authorized by it(IRA)to be eligible for bidding in the country.

Moreover, it reminded all procuring entities of the need to ensure they develop specific requirements relating to the goods, work and services being procured as well as fair and open competition amongst bidders.
