Kenya: Lenolkulal Put on Defence in Sh84.7Million Graft Suit After Prima Facie Finding

Nairobi — An Anti-Corruption Court sitting in Nairobi has found a prima facie case against former Samburu Governor Moses Lenolkulal in a 84.7 million fuel procurement deal flagged by the EACC.

In his findings on Friday, Anti-Corruption Chief Magistrate Thomas Nzioki ruled that Lenolkulal and nine other co-accused persons including county officials will be put on their defence.

Lenolkulal faces abuse of office, conflict of interest and unlawful acquisition of public property.

The court arrived at the prima facie finding after considering evidence adduced by 11 prosecution witnesses and 388 documentary exhibits.

Ethic and Anti-Corruption Commission (EACC) charged Lenolkulal after uncovering a questionable deal during his tenure as Governor.

"During his tenure as Governor, he traded with his County Government in the name of Oryx Service Station, which he owns, by supplying fuel worth over Sh84 Million," EACC noted.

The court slated a mention on July 27 for further orders on how the matter will proceed.

Leolkulal is among nine sitting and former Governors with ongoing court cases on corruption and economic crimes.

The offences presented in court are in breach of Section 48 of the Anti-Corruption and Economic Crimes Act, 2003 which attract up to a Sh1 million fine or imprisonment for a term not exceeding.

Section 48 also provides for "an additional mandatory fine if, as a result of the conduct that constituted the offence, the person received a quantifiable benefit or any other person suffered a quantifiable loss."

In determining the additional mandatory find, the court will set an amount equal to two times the amount of the benefit or loss.
