Kenya: DPP Ingonga to Review Charges Against Kakamega Deputy Governor Savula in Sh122 Million Fraud Case

Nairobi — The Director of Public Prosecutions (DPP) Renson Ingonga is set to review criminal charges against Kakamega Deputy Governor Ayub Savula in the Sh122 million fraud case facing him.

The prosecutor, told the trial magistrate Lucas Onyina when the matter came up for hearing that the DPP wants to review the file before any proceedings can take place.

"Your honour, some of the accused persons wrote to the DPP requesting review of the charges and upon review 9f the request, the DPP noted that there is new and compelling reasons that is new to the case," the prosecution counsel told court.

He told the court, that the review may affect the course of the hearing and sought two weeks to consult with the accused persons and their defense counsel.

The prosecution added that proceeding with the hearing as it is, it might be prejudicial to some of the accused persons.

"The application is made in good faith and its not meant in any way to delay thr case as the DPP is committed to have the matter heard expeditiously."

The defence lawyers led by Alutalala Mukwana, Stanley Kangahi, Cohen Amanda among others said they had no objection to the adjournment.

"We will not object to the application by the DPP to review the charges as some of our clients have lost jobs, some died and others retiring," lawyer Cohen told court.

They however prayed for expedious hearing of the case.

If it's anything that will cause a reprieve to my client then I have no objection, Kangahi added.

So far the Prosecution said 25 witnesses are remaining to testify in the case.

While granting the application for adjournment, the magistrate said he had considered the application and allowed as prayed.

The Magistrate directed that the case be mentioned on November 30 to confirm the position that has been taken by the DPP.

In the case Kakamega Deputy Governor Ayub Savula is charged alongside former ICT PS Sammy Itemere for stealing Sh122 million that was meant for paying pending bills to advertisers.
