Kenya: Energy State Department Asked to Disclose Power Projects in Marsabit

Nairobi — The Office of the Ombudsman has asked the State Department of Energy to disclose power projects in Marsabit to Gitson Energy Limited.

Under the Information Act, Ombudsman Commissioner Lucy Ndug'u argues that the right to information access is crucial unless limited by Section 6 of the same Act.

"Having carefully considered the request for information by the requester through a letter dated 11th January, 2022 (copy enclosed) regarding all the approved power projects in Marsabit County as of 31st December, 2021," Ndung'u said.

"The Commission opines that the requested information is held by your Authority. Under the Access to Information Act, the right of access to information is absolute unless limited by section 6 of the same Act," she added.

It therefore directed the Ministry of Energy to issue all information on approved power projects in the Northern Kenya devolved unit as of December 31, 2021.

"TAKE NOTICE THAT section 23(3) of ATI Act, 2016, provides that 'A person who is not satisfied with an order made by the commission under subsection (2) may appeal to the High Court within twenty-one (21) days from the date the order was made'."
