Nairobi — Over 300 aggrieved residents of Njiru and Mihang'o in Embakasi have filed an urgent application seeking an order to stop execution of the judgment of the court requiring them to vacate the parcel of land that they have been in occupation for a period exceeding two decades.

They want the court to put on hold the judgment issued by Justice Samson Okong'o requiring them to vacate with over 1,000 acres of land allegedly owned by the Kirima family.

They in their court documents say the Kirima family presented to court fake documents claiming ownership of the land. The resident disclosed that at the hearing of application, they will show the court that the suit property belongs to the Italian national Bernado Vicezo De Masi and not the Kirima family.

Justice Okong'o now based in Kisumu has in his judgment ordered the resident to vacate the disputed suit property by December 31st,2023.

During the hearing of the dispute before Environment and Land division, the Kirima family obtained an order gagging the media from covering the proceedings.

Two Members of Parliament Babu Owino (Embakasi East) and his counterpart Ronald Karauri have expressed same sentiments that suit property never belonged to Kirima family.

The MPs disputed the 1,000 acres of land in Njiru, Chokaa, and Mihango areas do not belong to the late Starehe MP Gerishon Kirima.

They alleged that the original owner of the land was an Italian national who procured it from a man of Indian descent in 1966. They further said the judgement of Justice Okong'o must be challenged before court to save the residents from eviction.
