Kenya: MP Files Petition to Stop Charges Against Controller of Budget Nyakang'o

Nairobi — West Mugirango Member of Parliament, Stephen Mogaka, has filed a petition seeking to stop the arrest and criminal charges brought against the Controller of Budget, Margaret Nyakang'o.

The petition, filed in the Nairobi High Court, names the Office of the Director of Public Prosecutions (ODPP) and the Directorate of Criminal Investigation (DCI) as respondents.

Mogaka, in his court papers, alleges that the arrest and charges against Margaret Nyakang'o are part of a conspiracy to force her out of office and infringe upon her right to dignity.

He stated, ''The arrest comes in the wake of her public exposes with regards to the fiscal improprieties within the running of various state arms and agencies and is a manifestation of a knee-jerk reaction with ulterior motives.''

The Member of Parliament has requested conservatory orders to halt Nyakang'o's trial and is urging the court to prevent the DPP, DCI, and Inspector General of Police from further investigating and prosecuting her.

These developments come just two days after Nyakang'o was arrested in Mombasa and subsequently arraigned on charges of forgery and conspiracy to defraud, which are related to a complaint made against her back in 2016.

Nyakang'o denied the charges and was released on a cash bail of Sh500,000 or a bond of Sh2 million. The court has scheduled the hearing for next Wednesday.

In addition to the forgery and conspiracy charges, Nyakang'o, along with 10 other individuals, faces charges related to operating a Sacco without a License and uttering a false document, as per the Penal Code. These charges were approved by the Office of the Director of Public Prosecutions in a letter sent to the Directorate of Criminal Investigations on November 30.
