Kenya: DPP Withdraws Charges Against Co-Accused in Kakamega Deputy Governor Savula's Case

30 January 2024

Nairobi — The Director of Public Prosecutions, Renson Igonga, has withdrawn criminal charges against 11 individuals who were co-accused alongside Kakamega Deputy Governor Ayub Savula.

The DPP said that upon reviewing the case file, there was insufficient evidence linking the accused persons to the alleged embezzlement of Sh122 million from the government through advertising.

During a hearing before Chief Magistrate Lucas Onyina, it was revealed that the DPP would require two weeks to amend the charge sheet for the remaining accused individuals, allowing the case to proceed.

The termination of the case was carried out under section 87(a) of the Criminal Procedure Code (CPC), with the DPP invoking his authority under Article 57 of the Constitution.

The trial magistrate has reserved his ruling for February 5, 2024, to determine whether he will grant the DPP's application to withdraw the charges against the accused individuals.
