Uganda: Wakooli Decision Tops Busy Day With Burora, Mawanda in Court

 Deputy Director of Public Prosecution Samali Wakooli has her decision cut out, today, as she appears in court to learn whether she can carry on as the lead prosecutor in the Katanga murder trial.

On another day, Ms Wakooli would have recused herself from the case, something the Molly Katanga defence team have already subtly told Judge Isaac Muwata's court.

But recusal is probably the last thing that could happen today.

On January 22, Wakooli signed a charge sheet stating that Ms Molly Katanga's DNA was found on the murder weapon.

However, the DNA report shared is dated April 30, which contradicts this claim.

Last week, defence lawyer Bruce Musinguzi punched holes into the case at its infancy by drawing the court to this inconsistency, suggesting potential prosecutorial bias.

"My Lord, on May 3, 2024, we were served with a DNA report. The DNA report on page 36 indicates that it was prepared on April 30, 2024," Musinguzi said.

"This was a prosecution-led initiative, and at the time, the prosecution signed and prepared the indictment on January 22, 2024. So we shall need Wakooli to come and tell us where she got it, yet it had not been prepared."

Today, Judge Muwata faces the critical decision of whether to allow Wakooli to testify or to address the flaws in the prosecution's case.

As well as the Ms Wakooli decision, Judge Muwata also must rule on the accused's request to attend the hearing via video link from Luzira Prison where she has been since January when she was hauled out of a hospital ICU facility and charged with the murder of her husband.

Ms Katanga denied killing her husband.

After five life-saving surgeries, the accused remains a patient on wheelchair and with Luzira fully equipped with video conferencing technology by the Judiciary, her request is likely to test Judge Muwata who has already denied her bail twice before.

Burora, Mawanda bail hearings

Meanwhile, at Buganda Road Court, former Rubaga Resident City Commissioner Herbert Anderson Burora will appear to seek bail.

Mr Burora was last week charged with hate speech and spreading malicious information against the person of the Speaker of Parliament for his posts on social media site X, formerly Twitter.

Mr Burora has been a vocal critic of Speaker Anita Among and the government excesses. Two months ago, he was suspended from office and later indicted.

Also headed to court will be legislators accused of licking the taxpayer coffers.

Igara East MP Michael Mawanda returns to the Anti-Corruption Court to seek bail after more than a week in the dungeons of detention facility.

Mr Mawanda, a prominent figure in General Muhoozi Kainerugaba-led People's League of Uganda civic organisation, was charged with embezzlement of billions of shillings from war loss compensation coffers in cooperative unions.

Busiki County MP Paul Akamba also has a date with the Anti-Corruption Court today although his bail application might put aside if he is committed to the High Court for trial instead.
