South African Court Blocks Shell’s Seismic Survey After Appeal

The Supreme Court of Appeal has dismissed, with costs, the appeal by Shell, Impact Africa, and the Department of Mineral Resources and Energy (DMRE), which sought to overturn a High Court ruling that had halted an oceanic seismic survey off the Wild Coast.

In 2022, the Makhanda High Court in Eastern Cape found that Shell's rights for oil and gas exploration off the Wild Coast had been granted unlawfully because of the failure to notify and consult affected communities. This meant that relevant considerations were ignored, such as the communities' right to food and livelihoods from the ocean and their spiritual and cultural rights.

The court also found that Energy Minister Gwede Mantashe failed to comply with the requirements of the Integrated Coastal Management Act.
