Submission on on Nomination of Justice Mogoeng as Chief Justice

The Judicial Services Commission (JSC) made a call for submissions ahead of their interview of Justice Mogoeng Mogoeng on 3 September 2011. SECTION27, Sonke Gender Justice, the Lesbian and Gay Equality Project and the Treatment Action Campaign have responded to this call.

In our submission we refer to judgments of Justice Mogoeng that are cause for concern. In particular the judgments reflect what appears to be Justice Mogoeng’s troubling attitude to sexual orientation and gender-based violence.  As a result we request the JSC to put questions to Justice Mogoeng regarding his views.

We express the view that, given the judgments, Justice Mogoeng is not appropriate for the position of Chief Justice.
